Derkak Construction Company is demanding that the Tema Metropolitan Assembly (TMA) pays monies owed the company following the procurement of 3,000 streetlights by the company for use in the Metropolis.
According to reports Derkak Construction Company was contracted by TMA to procure and fix 3,000 streetlights in the Tema Metropolis.
Norvanreports understands that the Assembly is said to have agreed to pay 40 per cent of the contract sum after a successful procurement with the remaining 60 percent paid in installments as the streetlights were being fixed.
TMA is said to however, defaulted in paying the agreed contract sum leading to the company initiating a suit against the Assembly.
The contract sum is however unknown.
The suit filed against TMA by Derkak Construction Company at an Accra High Court, was ruled in favour of the company. The Assembly was subsequently instructed by the High Court to make payments to the company.
TMA, despite the court’s order has still failed to settled debts owed the firm.
Reports indicate that, Derkak Construction Company on December 22, 2020, besieged the TMA with police officers to seize three pick-up vehicles and a Prado belonging to TMA in a bid to recover the debt.
Meanwhile, a court notice issued over the unpaid judgement debt has been pasted all over the walls of the TMA.
The court notice reads, “Whereas the writ dated 1st day of September 2020 at Accra, has been issued under the hand of his Hon. Lordship Justice Anin Yeboah, Chief Justice of Ghana at the instance of the judgment creditor DERKAK Con. Co. LTD for the attachment of the moveable and the immovable property of the judgment debtor Tema Metropolitan Assembly in the above-named suit.”
“The said judgment Debtor is hereby prohibited from alienating the property mentioned by sale, gift or in any other way and all persons are hereby prohibited from receiving the said property by purchase, gift or otherwise,” it further read.
