Draft NPA Bill Seeks to Modernise Fuel Pricing Structure and Sector Governance

  • Draft NPA Bill Seeks to Modernise Fuel Pricing Structure and Sector Governance

Ghana’s downstream petroleum sector is edging toward a significant legal and pricing reset, as the National Petroleum Authority pushes a new bill that would both overhaul parts of the fuel price build-up and replace an existing law the regulator now says has fallen behind the realities of the market.

The case for change is being made on two fronts at once. On one hand, the draft NPA bill proposes structural reforms to the way key petroleum levies and margins are organised. On the other hand, NPA Chief Executive Edudzi Tamakloe Esq., says the wider legal foundation of the downstream sector needs updating because the current Act, passed in 2005, can no longer fully respond to new developments in the industry.

Addressing Parliament’s Energy Committee, Tamakloe argued that the present law had served the country, but could not be expected to anticipate the full range of changes now confronting the sector. “So, 20 years after the enactment of the NPA Act in 2005, it will become necessary for us to catch up with industry growth, industry perspective, and the new evolving matters that are coming up,” he said.

That broader legislative argument gives the pricing reforms a different weight. The bill is not being presented merely as a technical cleanup of charges embedded in pump prices. It is being framed as part of a wider attempt to modernise how Ghana regulates, finances, and invests in the downstream petroleum industry.

At the centre of the draft reforms is a proposal to merge the Unified Petroleum Pricing Fund and the Primary Distribution Margin into a single vehicle, to be called the Distribution Fund. Lawyer Tamakloe said the intention is to bring two separate cost-recovery channels under one structure. “The UPPF and the PDM will now be what is called the Distribution Fund,” he said.

That change, the NPA Boss says matters because both the UPPF and PDM are deeply embedded in Ghana’s fuel pricing architecture. They help cover the cost of moving and distributing petroleum products, but they have also long attracted scrutiny for their complexity, opacity, and the wider burden they place on consumers and marketers. Folding them into a single fund suggests the regulator wants a simpler and more coordinated framework for managing distribution-related charges.

The bill is also said to create an Infrastructure Fund, into which the BOST margin and related components would be channelled to support strategic investment in the sector. “The BOST margin, among others, will go into what is now known as the Infrastructure Fund,” Lawyer Tamakloe said.

In effect, the NPA appears to be trying to separate two different logics inside the current pricing structure: one linked to distribution and logistics, and another tied to longer-term infrastructure needs. If implemented well, it could make the system easier to understand and potentially easier to govern. But it also raises a harder question for the market: whether administrative streamlining will translate into lower costs or simply repackage existing burdens inside new institutional labels. That remains unclear from the bill as it has been described so far.

The draft law also touches the LPG market through the Cylinder Recirculation Investment Margin, which Lawyer Tamakloe said places an $80 charge on every metric tonne of LPG to support Ghana’s cylinder recirculation model. He argued that the point of the levy is to stop the full infrastructure burden from falling directly on consumers when large bottling companies invest. “The whole essence is to absorb the cost relative to the cylinder recirculation model because you do not want the big bottling companies; when they invest, the state must find a way of compensating,” he said.

Taken together, the proposals suggest a regulator trying to do more than enforce existing rules. The NPA is positioning itself as the architect of a new downstream framework in which pricing, cost recovery, infrastructure finance, and legal oversight are more explicitly aligned with sector growth and operational efficiency. Lawyer Tamakloe, the NPA Boss, told Parliament that the Authority is focused on supporting national development through effective regulation and improved service delivery.

For Ghana’s downstream sector, the significance of the proposed law lies not only in the new funds it would create but also in the philosophy behind it. The current message from the NPA is that a law written two decades ago can no longer adequately govern a market that is now shaped by more complex pricing pressures, rising infrastructure demands, energy security concerns, and new expectations of transparency.

That leaves the draft bill carrying a larger burden than a routine regulatory amendment. It is being asked to show that Ghana can modernise petroleum governance without deepening confusion in fuel pricing and improve sector efficiency without losing public trust. In downstream reform, that balance is usually where the politics begins.
